Damage Caps

Since 1975 Louisiana has had in place statutory caps on the amount of damages available to be awarded in medical malpractice cases. This amount, Five Hundred Thousand Dollars ($500,000.00) has never been adjusted for inflation. It covers both economic damages (like lost wages) and non-economic damages (pain and suffering), however the cap does not apply to medical expenses incurred, past or future, related to the medical malpractice.
